Description

The Tort Law of the People’s of the Republic of China came into force on 1 July 2010. Divided into 12 chapters and containing 92 articles, the new law sets out general and specific torts, types of liability (i.e individual, vicarious and third party), extent of liability (i.e joint and several), and types of remedies (i.e cessation of infringement and compensation to the victim).

Tort Law in China is the first and only book in English that provides a comprehensive discussion on each article of the PRC Tort Law, noting significant developments achieved by its enactment, drawing comparisons to relevant common law tort principles, and how certain parts of the law developed and what factors were considered in the drafting of provisions. This book will not only appeal to lawyers, academics and students, but also to those with cross-border interests and foreign companies in China.

• Compares common law principles and cases

• Formatted in a simple and user-friendly manner, with both the Chinese and English texts of each article set out for comparison

• An incisive and practical analysis of the major principles in tort law, with discussions and commentary of recent judicial decisions in China

• Useful for those who seek to understand the differences and similarities between common law tort principles and tort law principles in China
